Welcome to StackGrade (“StackGrade”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the StackGrade mobile application, website, and related services (collectively, the “Platform”). By accessing or using StackGrade, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Platform. 1. About StackGrade StackGrade is a professional networking and opportunity platform designed to connect developers and recruiters through: Professional developer profiles Job opportunities Community projects Talent discovery Application management StackGrade provides infrastructure and discovery tools but does not act as an employer, staffing agency, recruitment agency, or guarantor of employment outcomes. 2. Eligibility To use StackGrade, you must: be at least 16 years old; comply with all applicable laws in your jurisdiction; provide accurate account information; and use the Platform for lawful and professional purposes only. Users under the age of 18 are responsible for complying with local laws regarding employment eligibility and digital consent. 3. Account Registration Users may access StackGrade using supported authentication providers, including Google Sign-In. By creating an account, you agree that: the information you provide is accurate and current; you are responsible for maintaining the security of your account; you are responsible for all activity under your account; and you will not share or transfer your account to another person. We reserve the right to suspend or terminate accounts that violate these Terms or compromise Platform security. 4. User Profiles 4.1 Developer Profiles Developer users may create profiles containing professional information including: skills and technologies; work experience; resumes/CVs; portfolio links; salary expectations; availability information; and contact information voluntarily provided by the user. Developers are solely responsible for the information they publish and share through the Platform. 4.2 Recruiter Profiles Recruiter users may create company-related profiles and publish job opportunities. Recruiters are responsible for ensuring that: opportunities are legitimate; information is accurate; job descriptions are lawful and non-discriminatory; and hiring-related communications comply with applicable laws. 5. Public Content and Visibility Certain profile information may become visible to other users depending on Platform functionality and profile visibility settings. By enabling a public profile or submitting information through StackGrade, you acknowledge that authorized users may access and view that information within the Platform. Users are responsible for the information they voluntarily choose to make visible, including: resumes/CVs; WhatsApp numbers; email addresses; portfolio links; and external contact information. 6. Applications and Opportunities StackGrade allows users to apply to projects and job opportunities. By submitting an application, you understand that your information may be shared with the owner of the corresponding opportunity. Opportunity owners are solely responsible for: reviewing applicants; managing communications; hiring decisions; and compliance with local employment laws. StackGrade does not guarantee: employment; project acceptance; candidate selection; response times; or business outcomes. 7. Acceptable Use You agree not to: violate any law or regulation; impersonate another person or company; publish false or misleading information; upload malicious code or harmful content; scrape, copy, or harvest Platform data without authorization; interfere with Platform security or infrastructure; use the Platform for spam or unsolicited communications; post discriminatory, abusive, or illegal content; attempt unauthorized access to other accounts or systems; or misuse public profile information obtained through StackGrade. We reserve the right to remove content or suspend accounts that violate these Terms. 8. Uploaded Files and Content Users may upload files including resumes/CVs, profile images, and company logos. By uploading content to StackGrade, you represent that: you own the content or have the necessary rights to share it; the content does not violate third-party rights; and the content complies with applicable laws. You retain ownership of your content. However, you grant StackGrade a limited, non-exclusive license to host, process, display, and distribute uploaded content solely for operating and improving the Platform. 9. Intellectual Property The StackGrade Platform, including its branding, design, software, interfaces, and original content, is owned by StackGrade and protected by applicable intellectual property laws. Users may not: copy; reproduce; distribute; reverse engineer; or commercially exploit any part of the Platform without prior written permission. 10. Third-Party Services StackGrade may rely on third-party providers and integrations including cloud infrastructure, authentication providers, notification systems, and external APIs. Use of third-party services may also be subject to their own terms and privacy policies. StackGrade is not responsible for third-party platforms, websites, or services. 11. External Communications The Platform may allow users to share external contact information such as: WhatsApp numbers; email addresses; GitHub profiles; and personal websites. StackGrade does not monitor or control communications that occur outside the Platform. Users interact with third parties at their own risk. 12. Account Termination and Deletion Users may delete their accounts through the Platform. We may also suspend or terminate accounts that: violate these Terms; create security risks; engage in fraudulent activity; or misuse the Platform. Upon account deletion or termination, associated data may also be removed according to our Privacy Policy and operational requirements. 13. Disclaimer of Warranties StackGrade is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, StackGrade disclaims all warranties, express or implied, including warranties related to: availability; reliability; fitness for a particular purpose; uninterrupted service; and accuracy of content provided by users. We do not guarantee that the Platform will always be secure, error-free, or continuously available. 14. Limitation of Liability To the maximum extent permitted by law, StackGrade and its owner shall not be liable for: indirect or consequential damages; loss of profits; employment decisions; hiring outcomes; user interactions; external communications; user-generated content; or unauthorized access caused by circumstances beyond reasonable control. Your use of the Platform is at your own risk. 15. Future Paid Features StackGrade may introduce paid features, subscriptions, premium recruiter tools, or other monetized services in future versions of the Platform. Additional terms may apply to such services when introduced. 16. Changes to the Terms We may update these Terms from time to time. When material changes are made, we may notify users through the Platform or other appropriate communication methods. Continued use of StackGrade after updated Terms become effective constitutes acceptance of the revised Terms. 17. Governing Law These Terms shall be governed and interpreted in accordance with the laws of Mexico, without regard to conflict of law principles. Any disputes arising from these Terms or use of the Platform shall be subject to the applicable courts and legal authorities of Mexico. 18.
